1. Acceptance of Terms

By accessing or using LustChat.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

2. Age Requirement

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old. We may terminate your account if we discover that you are under 18. You may not engage in any role-play or content that depicts, suggests, or sexualizes persons who are, or appear to be, under 18 (including "young-looking" or "age-play" scenarios). We may require age verification and reserve the right to deny access where verification is not completed to our satisfaction.

3. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service or through other communications. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

4. Access and Use of the Service

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial purposes. You agree not to use the Service for any illegal or unauthorized purpose.

5. Account Registration

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. User Content

You are responsible for any content you post, upload, or otherwise make available through the Service ("User Content"). You represent and warrant that you have all necessary rights to your User Content and that it does not violate any laws or third-party rights. You grant us a worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your User Content in connection with the Service.

7. Prohibited Conduct & Content Restrictions

You agree not to:

  • Post, generate, upload, share, or transmit any content that is illegal, harmful, exploitative, or otherwise prohibited, including (without limitation):
    • CSAM / sexualization of minors: Any content (real, fictional, generated, or simulated) that depicts, suggests, sexualizes, or exploits persons under 18, including "young-looking" characters or "age-play".
    • Non-consensual sexual content: Rape, sexual violence, exploitation, incest, revenge porn, or any content involving coercion or lack of consent.
    • Bestiality: Any sexual content involving animals.
    • Deepfakes / face-swaps / voice clones: Creation, upload, or distribution of sexual or exploitative deepfake content (including face-swaps or voice synthesis) of real persons (celebrities, public figures, or private individuals) without their explicit, verifiable consent.
    • Real-person sexual content without consent: You may not use the Service to generate, depict, or simulate sexual content involving identifiable real individuals without their explicit consent. Falsely claiming consent is prohibited.
    • Extreme violence or gore.
    • Trafficking or exploitation: Content that promotes or facilitates human trafficking or sexual exploitation.
    • Illegal activity: Any content that violates criminal law or promotes illegal activities.
    • Harassment or discrimination: Content that is harassing, abusive, or discriminatory.
    • IP violations: Content that infringes or misappropriates third-party intellectual property rights.
  • Use the Service to impersonate any person or entity, or to create content that misleads others about your identity or the identity of persons depicted.
  • Attempt to bypass, disable, or interfere with safety systems, moderation filters, rate limits, or access controls (including prompt "jailbreaking" intended to produce restricted outputs).
  • Engage in any activity that could disable, overburden, or impair the Service.
  • Collect or store personal data about other users without their consent.

Definitions. “Minor” means any person under 18 years of age. “Deepfake” includes AI-generated or manipulated audio, video, or images (e.g., face-swaps, voice cloning) that depict a real person.

Enforcement & Reporting. We may remove content, suspend or terminate accounts, and restrict access at our sole discretion for any violation of these Terms. We will report any suspected CSAM or other illegal content to relevant law enforcement and reporting hotlines as required by law (e.g., NCMEC, IWF or their local equivalents). We may preserve and disclose information to authorities where legally required.

Safety Systems. To protect our users and comply with the law, we use automated and manual moderation measures that may scan prompts and outputs, block or hold content for review, log activity for safety, and limit features where necessary. Attempts to evade these measures are prohibited.

8. Other Users

Each user is solely responsible for their own User Content. We do not control or endorse any User Content and make no representation regarding its accuracy or reliability. You agree that we are not responsible for any loss or damage resulting from your interactions with other users.

9. Feedback

If you provide us with any feedback or suggestions regarding the Service, you grant us the right to use such feedback without any obligation to you.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by LustChat.ai and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11. Copyright Policy

We respect the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our copyright agent with a written notification containing the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to be infringed;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
  • Your contact information, including your address, telephone number, and email address;
  • A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Our copyright agent can be reached at support@lustchat.ai. We operate a repeat-infringer policy which may result in account termination.

12. Termination

We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms or where required by law.

13. Disclaimers

The Service is provided "as is" and "as available" without any warranties of any kind. We do not warrant that the Service will be uninterrupted, secure, or error-free. The AI responses are generated automatically and may not always be accurate or appropriate.

14. Limitation of Liability

To the fullest extent permitted by law, LustChat.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

15. Indemnification

You agree to defend, indemnify, and hold harmless LustChat.ai and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or your violation of these Terms.

16. Refund Policy

All purchases made on LustChat.ai, including but not limited to subscriptions, coins, and other digital goods, are non-refundable except where required by law. Once a purchase is completed, you will not be eligible for a refund, return, or exchange.

If you believe you have been charged in error or experience technical issues that prevent you from accessing purchased features, please contact us at support@lustchat.ai within 7 days of your purchase. We will review refund requests on a case-by-case basis and grant refunds only at our sole discretion.

Any approved refunds will be credited back to your original payment method. We do not issue refunds in cash, check, or to alternative payment methods.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of law provisions.

18. Miscellaneous

These Terms constitute the entire agreement between you and LustChat.ai regarding the Service. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
